Terms of service

Last updated 3 November 2026

These terms are an agreement between you and Actuate ("we") for your use of actuate.run, the dashboard, API, gateway and hosted runtime (the "service"). By creating an account or using the service, you accept them. If you use Actuate for an organisation or a client, you accept them on its behalf and confirm you are allowed to.

The service

Actuate hosts TypeScript programs ("actuators") that you write or deploy, runs them when they are called, and stores their run history and databases. The open-source SDK, runtime, CLI and provider adapters are licensed separately under Apache-2.0; these terms cover the hosted service.

Your account

Acceptable use

You must not use Actuate to:

You must also follow the terms of every third-party service your actuators use (for example WhatsApp, Telegram, Stripe or an LLM provider). Those services are provided by their operators, not by us.

Your code and data

Plans and billing

Availability and changes

We work to keep Actuate available and reliable, but we don't guarantee it will be uninterrupted or error-free, and there is no service level agreement unless we agree one with you in writing. We may change or discontinue features. If we discontinue the service, we will give at least 30 days' notice so you can export your data.

Suspension and termination

Disclaimers

The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Actuators run code you or your agents choose; we are not responsible for its effects, including messages sent, payments created or refunded, or data changed.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

Indemnity

You agree to cover our reasonable losses and costs from claims by third parties arising from your actuators, your data, or your breach of these terms.

Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction over disputes about them. This doesn't take away rights you have under the consumer law of the country where you live.

Changes to these terms

We may update these terms. We will post the new version here with a new date and, for material changes, email you at least 14 days before they take effect. Continuing to use Actuate after that means you accept them.
